Jakub Sojka jailed for raping girl, 15, in Motherwell after demanding she take 'powdered substance'

A man who demanded a 15-year-old girl consume a powder, detained her against her will and then raped her while she was intoxicated with drugs has been jailed for seven years.

Jakub Sojka, 32, met the schoolgirl in a Motherwell street before taking her to his home in the North Lanarkshire town on 1 March 2021.

Once inside, he demanded the teenager take a powder substance and uttered threats of violence against her family.

A court heard how Sojka struck his victim's head against a door, grabbed her by the hair and repeatedly seized her neck.

After detaining her against her will, he then sexually assaulted and raped her while she was intoxicated and unable to give or withhold consent.

Judge Thomas Welsh KC said: "You took advantage of a vulnerable teenage girl.

"Your defence of consent was rejected by the jury and you have shown no remorse in relation to this matter."

The judge said the damage done was "incalculable".

He added: "The victim impact statement, which I have read, shows how deep and lasting the effects of your conduct will be on the victim."

Sojka denied any wrongdoing but was last month convicted of rape and sexual assault following a trial at the High Court in Glasgow.

Additional initial charges of drug supply to the girl were earlier withdrawn.

Sojka was sentenced to seven years in jail at the High Court in Edinburgh on Tuesday.

He was also added to the sex offenders' register indefinitely and banned from contacting his victim for 10 years.

Defence solicitor advocate Rhonda Anderson said Sojka continued to maintain his innocence on the rape offence.

She added that her client had a good history of employment and strong family bonds but would inevitably be deported to his homeland of Poland following prison.

Katrina Parkes, Scotland's procurator fiscal for high court sexual offending, said: "Jakub Sojka carried out this appalling, opportunistic attack on a young girl who was vulnerable.

"He will now face the consequences of his predatory actions thanks to the bravery of his victim in reporting him."
